It also applies to foreign cosmetic manufacturers whose products enter the U.S. market, and to the brand owners (Responsible Persons) who market these products. If your facility is located outside the United States, yes. FDA requires foreign cosmetic facilities to appoint a U.S. Agent who can receive communications on their behalf. FEI stands for FDA Establishment Identifier. It is the number FDA uses to identify a registered facility. If your facility does not already have one, we obtain it for you as part of the Support Plan at no extra cost.
MoCRA has a small business exemption for certain facility registration obligations, but not all small cosmetic businesses qualify. Product listing obligations apply more broadly. Tell us about your business and we will review whether the exemption applies to you.
Yes. Foreign cosmetic facilities are required to register with FDA if their products are sold in the United States. We work with international companies regularly and our plans include the U.S. Agent service required for foreign facilities.
Cosmetic products that are not in compliance with MoCRA may be refused entry into the U.S. or subject to enforcement actions by FDA. Registering and listing products is the best way to avoid these risks.
